Legal practitioners can and do disagree on what Hart calls penumbral (or borderline) points relating to the assorted amendments. On Coleman’s view, there’s nothing in Hart’s evaluation of social guidelines that precludes such borderline disagreements about whether a follow is in keeping with the Fifth Amendment. According to this view, legal ideas are like legal guidelines in that each derive their authority under the rule of recognition from the official acts of courts and legislatures.
